Delaware Air Pollution Control Regulations

The state has adopted regulations governing the use of industrial cleaning solvents.  Any facility emitting more than 5 tons of VOCs per year from use of cleaning solvents is subject to the rule’s requirements. Facilities located in New Castle or Kent counties with the potential to emit 25 tons of volatile organic compounds per year, and facilities located in Sussex County with the potential to emit 50 tons of volatile organic compounds per year are required to either utilize control and capture efficiencies to reduce emissions or to utilize inks with not more than 3.5 pounds of VOC per gallon, less water and exempt solvents as applied. 

All facilities are also required to maintain daily records to demonstrate compliance. If your potential emissions are below these limits, then you are required to submit, upon request, records that document that you are exempt from these requirements. If a request is issued, and you do not respond within 30 calendars days, then you will be required to follow the rules outlined above. Any new facility that has a net increase or the potential to emit 25 tons of Volatile organic compounds per year in either New Castle or Essex or 50 tons per year in Sussex is subject to these rules, as well.
