New Mexico Air Permitting Issues

New Mexico has a Title V permit program in place. Sources with the potential to emit more than 100 tons of VOCs per year, or 10 tons of one hazardous air pollutant (HAP) or 25 tons of a combination of HAPs are required to apply for a Title V Permit.
If a facility's potential emissions of VOC are 10 tons per year, then the facility must file a notice of intent with the state. Facilities may be required to obtain a construction permit if the potential rate of emissions from the equipment is 10 pounds per hour or 25 tons per year of any regulated pollutant, which includes VOCs.
If a facility is required to obtain a permit or register with the New Mexico Environment Department's Air Quality Bureau, then an annual emissions inventory must be submitted to the Department.
