The Toxics in Packaging Clearinghouse has released a new sample Certificate of Compliance for companies to use when providing a certificate stating that a package or packaging component is in compliance with the requirements of the law. The Model Toxics in Packaging Legislation was developed in 1989 to reduce the amount of four heavy metals, specifically lead, cadmium, mercury, and hexavalent chromium, in packaging and packaging components sold or distributed throughout the states. Legislation based on this Model has been adopted by nineteen states.
The new certificate has been amended to contain the following statement: “no materials used to replace the regulated chemicals are present in a quantity or manner that creates a hazard as great or greater than the hazard created by the regulated chemicals.”
The 19 states that have adopted the legislation include: California, Connecticut, Florida, Georgia, Illinois, Iowa, Maine, Maryland, Minnesota, Missouri, New Hampshire, New Jersey, New York, Pennsylvania, Rhode Island, Vermont, Virginia, Washington, and Wisconsin.
